Under the Color of Law: Florida Families Plead for Federal Investigation

Dear Acting Attorney General Blanche,

I watched the White House proceedings yesterday and heard your joyful exclamation about the conviction in Florida of a healthcare software executive involved in a staggering $1 billion Medicare fraud conspiracy targeting senior citizens.

According to the DOJ press release, the scheme used telemarketing, false doctor orders, kickbacks, and medically unnecessary equipment to exploit vulnerable elderly Americans and defraud taxpayers on an industrial scale.

The Department described the case as “cold, calculated, industrial-scale theft targeting the sick and elderly.”

Congratulations on a job well done, sir!

Now we have a bigger fish to fry and we hope you can help us.

Many families across Florida would tell you they are witnessing another form of organized exploitation of seniors — one operating inside probate courts and guardianship systems.

And in their view, it is even worse.

Why?

Because unlike Medicare fraud schemes operating in the shadows, probate and guardianship exploitation often occurs under the appearance of legitimacy: court orders, judicial signatures, professional guardians, attorneys, evaluators, vendors, and court-appointed fiduciaries.

Families throughout Florida have described remarkably similar patterns:
• Elderly individuals isolated from loved ones
• Emergency guardianships imposed with little due process
• Rapid liquidation of assets
• Excessive fees draining estates
• Forced sales of homes and property
• Questionable medical determinations
• Entire networks of professionals repeatedly benefiting financially from the same cases

Many believe generational wealth is being systematically consumed through processes that few outsiders understand and almost no one dares challenge.

The tragedy is not simply financial. It is emotional, familial, and deeply human.

Adult children attempting to protect parents are often portrayed as unstable or disruptive. Seniors lose their autonomy. Families become financially destroyed attempting to fight the system. Victims frequently pass away before accountability ever arrives.

The public struggles to believe these stories because they are conditioned to trust institutions wearing robes, credentials, and court authority.

But the sheer volume of similar complaints across Florida should concern every federal investigator focused on elder exploitation.

If the Department of Justice can successfully dismantle billion-dollar healthcare fraud conspiracies involving coordinated networks of professionals, then surely it is time to examine whether similar patterns exist within probate and guardianship systems.

Imagine the value of a true federal investigation examining:
• Repeat professional appointments
• Coordinated financial relationships
• Estate depletion patterns
• Emergency guardianship filings
• Property transfers
• Vendor connections
• Billing practices
• Judicial conflicts
• Financial ecosystems surrounding high-value estates

Florida is home to one of the nation’s largest senior populations and one of the greatest transfers of generational wealth in America. That reality alone should warrant heightened federal scrutiny.

Families are no longer alleging isolated misconduct by one dishonest individual. Many believe organized exploitation is occurring in plain sight.

The DOJ’s recent Medicare fraud victory proved something important: large-scale exploitation of seniors can exist behind layers of professional legitimacy.

The question now is whether federal investigators are willing to look inside probate and guardianship systems with the same determination.
